Article I: Purpose

This agreement stipulates the rights, duties, and responsibilities of users and the Seoul Museum of Art (hereafter "The Museum") in the use and process of all services provided by The Museum (hereafter "Services").

Article II: Validity and Amendment of the User Agreement

  1. When those users who wish to become members complete the process stipulated by The Museum and wear the registration button, they will be understood to have agreed to the terms of this User Agreement. Rights, duties, and responsibilities not included in this User Agreement shall be in accordance with the relevant statutes and commercial practices of the Republic of Korea.
  1. The Museum may amend the User Agreement. Changes to the User Agreement are to be posted on The Museum homepage for users¡¯ perusal. Users who do not agree to changes in the User Agreement may cancel their membership. Those who continue their membership shall be understood to have agreed to the changes in the User Agreement. Changes to the User Agreement shall come into effect upon their announcement.

Article III: Regulations not covered by the User Agreement

  1. This User Agreement is applicable, along with other regulations and User Agreements, to Services provided by The Museum.
  1. Stipulations not covered in this User Agreement shall be in compliance with the Electronic Communications Law, the Electronic Commerce Law, Regulations of the Electronic Communication Ethics Commission, the Program Protection Law, and all other related statutes.

Article IV: Definitions

The definitions of terms used in this User Agreement are as follows:

  1. A "user" is an individual who receives services from The Museum in accordance with this User Agreement.
  1. "Membership" is the act of completing membership application forms provided by The Museum, agreeing to the terms of this User Agreement, and completing the Use Contract.
  1. A "member" is an individual who receives information and uses the Services provided by The Museum, having provided personal information and registered as a member with The Museum.
  1. "Withdrawal" is the act of terminating the Use Contract.

Article V: Conclusion of Use Contract

  1. The Use Contract shall be concluded when the applicant becomes a member after having completely filled out all items required on the on-line application form as stipulated by The Museum.
  1. The Museum may cancel membership on one or more of the following grounds:
  • The use of a name other than the applicants on membership application forms
  • The provision of false information on the User Contract application form
  • Application for the purpose of disturbing public peace and order or subverting public morality
  • Use of The Museum homepage for activities prohibited by law or this User Agreement
  • Use of The Museum homepage for the slander and defamation of others
  • Failure to fulfill other requirements for application as stipulated by The Museum

Article VI: Cessation of Service

  1. The Museum may temporarily cease the provision of Services in the event of the repairs, inspection, replacement, malfunction, or the loss of communications. The Museum may completely cease currently provided services in the event The Museum deems it appropriate to replace them with new services.
  1. In the event of cessation of services in accordance with Article VI.1, The Museum shall inform users in accordance with procedures stipulated in Article VIII.2. In situations in which the cessation of services is beyond the control of The Museum, such as system crashes or disc corruption not resulting from the intent or negligence of the system managers, advance notice will not be possible.?

Article VII: Membership Withdrawal and Disqualification

  1. Users may delete their own membership registration on The Museum homepage at any time. The Museum will delete membership registration immediately upon user request.
  1. The Museum may limit, suspend, or cancel membership registration on one or more of the following grounds:
    • Provision of false information on membership application forms
    • Theft information or any threat to electronic transactions
    • Use of The Museum homepage to engage in activities prohibited by law or this User Agreement or to disturb the peace or subvert public morality
  1. In the event that The Museum decides that a user is ineligible for membership, membership registration will be deleted. In such cases, the member shall be informed in advance and given the opportunity to respond.?

 

Article VIII: Notification of Users

  1. In the event that The Museum notifies specific users, said users may use the e-mail address on The Museum homepage.
  1. In the event that The Museum sends a general notification to all users, the notification may be posted on The Museum homepage during a limited time in place of individual notifications.

Article IX: Privacy Policy

The Museum strives to protect users' registration and personal information in accordance with the law and policies stipulated by The Museum.

Article X: Museum Duties

  1. The Museum shall neither engage in any action prohibited by this User Agreement nor subvert public order and customs. The Museum will strive to continuously and consistently provide services in accordance with this User Agreement.
  1. The Museum shall not send any commercial e-mail not desired the user.
  1. The Museum shall compensate users for losses incurred as a result its intent or serious error.

 

Article XI: User ID and Password

  1. Aside from the responsibilities stipulated in The Museum privacy policy, users are responsible for managing their own IDs and passwords.
  1. Users should not allow their IDs and passwords to be used by third parties.
  1. In the event that a user ID and password are stolen and a third party uses an account without authorization, the user shall immediately inform The Museum and follow instructions.?

 

Article XII: Duties of Users

  1. Users are prohibited from the following activities:

i. Submitting false information on membership application forms

ii. Altering information posted on The Museum homepage

iii. Infringing upon personal or intellectual property rights or impeding business

iv. Using another ID without authorization

v. Sending junk mail, spam, chain letters, urging membership through pyramid schemes, sending messages with obscene or violent textual, animated, or audio content, posting or exhibiting information in violation of public morality

vi. Sending mail under the names of The Museum staff or service managers

vii. Interference with the operation of computer software, hardware, or information and communications facilities, intentionally posting or sending e-mail containing software viruses or other computer codes, files, or programs with the intent to disrupt services

vii. Gathering, saving, or disseminating users personal information without authorization

viii. Using Museum services for commercial purposes, sending bulk e-mail advertisements to unspecified recipients

ix. Violation of this or other User Agreements

  1. In the event that a user engages in any of the above listed prohibited activities, The Museum may limit, suspend, or cancel membership in accordance with Article 7.2 and Article 3 of this User Agreement
  1. Users shall compensate damages they cause to The Museum or other users.

 

Article XIII: Competent Court

Disputes arising in relation to use of this service shall be subject to the laws of the Republic of Korea. Litigation arising from such disputes shall be brought before a court of the Republic of Korea in accordance with the Code of Civil Procedure.
